Conventional H-1B filings

Currently, USCIS H-1B adjudication processing time for a conventionally filed petition is 100 days. Therefore, University departments, expecting to hire an international worker in H-1B category, must factor in this time period when determining their workforce requirements. Additionally, the 100 day processing period commences after FFS has received all petition supporting documents from the department and the petition has been properly filed with USCIS.

Premium Processing

USCIS provides expedited H-1B service and guarantees petition adjudication within two weeks. Again, this adjudication period reflects the period of time after FFS has received all petition supporting documents from the department and the petition has been properly filed with USCIS. The government's premium processing fee is $1000 and is in addition to other filing fees.

H-1B Portability

Employees that are selected for employment with CWRU, but, that are currently employed as an H-1B with another employer, may port their H-1B status to CWRU under certain conditions. First, the prospective employee must remain employed with his/her current employer until FFS has filed its petition, in behalf of the prospective employee, with USCIS. Secondly, FFS must receive confirmation that its petition has been received at USCIS. Upon completion of these two events, the prospective employee's department, at CWRU, will be notified that employee is eligible for employment.

J-1, Exchange Visitor Program

Please note the J-1, Exchange Visitor Program is not affected by these requirements, as it is run through the Department of State and uses the SEVIS electronically accessable database. Internal processing times for DS-2019s can be as little as two weeks, depending on the number of cases in the queue.
